1. Acceptance of Terms
By accessing or using any service provided by Karizanta LTD ("Karizanta", "we", "us", "our"), including but not limited to virtual private servers (VPS), dedicated CPU plans, and related hosting services, you agree to be bound by these Terms of Use. If you do not agree, do not use our services.
2. Service Description
Karizanta provides virtual server hosting under two distinct service tiers:
- Shared vCPU plans — best-effort compute performance. Displayed vCPU counts represent the maximum burst allocation; actual sustained CPU access is limited by a CPU Limit value disclosed on each plan's product page. Resources are shared across multiple customers on the same physical host.
- Dedicated CPU plans — guaranteed, non-oversold core allocation. The number of cores listed is reserved exclusively for the customer and is not shared with other tenants.
3. Acceptable Use Policy (AUP)
Applies to Shared vCPU plans only: Sustained CPU usage above 70% of the allocated CPU Limit for more than 30 consecutive minutes may result in throttling, warning, or suspension, at Karizanta's discretion, in order to protect the stability of the shared host for other customers.
Applies to Dedicated CPU plans: The above sustained-usage restriction does not apply. Customers on Dedicated CPU plans may use up to 100% of their allocated, reserved cores continuously without throttling or suspension on CPU-usage grounds alone.
Applies to all plans: You may not use Karizanta services for: illegal activity, distribution of malware, unsolicited bulk email (spam), denial-of-service attacks, cryptocurrency mining without prior written consent, or any activity that violates the rights of third parties or the laws of the United Kingdom or the customer's local jurisdiction.
4. Billing and Account Balance
Some plans require a minimum account balance before provisioning. Details on how account credit is funded, used, and whether it is refundable are governed by our Refund and Returns Policy, not by this section.
5. Service Availability
Karizanta will use commercially reasonable efforts to maintain service availability but does not guarantee uninterrupted access. In the absence of a stated SLA, services are provided on an "as available" basis.
6. Limitation of Liability
To the maximum extent permitted by law, Karizanta's total liability for any claim arising from use of our services is limited to the amount paid by the customer for the affected service in the month the claim arose. Karizanta is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business, except where such limitation is not permitted by applicable law.
7. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
